Current system of laws and regulations in the residential environment noise field 주거환경 소음분야의 법규 체계에 관한 연구

Abstract

To mitigate noise pollution in apartment buildings, noise-related regulations have been established and enforced in Korea. These regulations address multiple noise sources, including floor impact noise, inter-floor and inter-household noise, as well as external environmental noise. However, the regulatory approaches and minimum performance criteria vary depending on the jurisdiction and administrative authority of each responsible ministry. This study examines the current regulatory framework and performance standards governing residential noise in Korea, identifies existing challenges, and proposes potential measures for improvement. Through the adoption of these measures and a gradual, evidence-based approach to reform, Korea’s residential noise regulatory system can evolve toward a more coherent, stable, and effective framework for managing urban noise pollution.

이웃 사이의 소음 문제에 취약한 아파트 주거환경을 일정 수준 이상으로 유지하기 위해 다양한 소음분야 법규가 제정, 적용되고 있다. 바닥충격음, 층간소음, 세대간소음, 외부소음 등의 소음원에 대한 법규가 그것이다. 그러나 각 법규의 주무부처에 따라 규제의 방법이나 최소성능 기준이 서로 일관되지 못한 부분이 있다. 이 연구에서는 우리나라 주거환경 소음분야 법규의 체계 및 수준을 조사하고 그 현황의 문제점 및 개선 방안을 제시하였다. 향후 이 연구에서 제기된 문제의 본질을 이해하고 이를 개선해나가는 피드백 체계가 마련되어야 한다. 이러한 점진적 개선방향에 의해 향후 우리나라의 주거환경 소음분야 법규 체계가 더욱 안정적인 틀을 갖추어나갈 수 있을 것이다.
